The Austin Police Department arrested 54 people within an eight-hour span during the Halloween “no refusal” weekend.

Out of those arrests, 26 people refused to give a sample of their breath, but after a search warrant was signed by a judge, they had their blood drawn.

Of the lot, seven people had a blood alcohol level twice the legal limit, 19 had a blood alcohol limit higher than that.

“I would need another team of officers to do it full-time,” Lt. David Mahoney said. “So I would say, I would like to do it more often, but right now, we are only sticking to large holidays or weekends where statistics show there are large numbers of DWI arrests.”

  1. Heard tonight that Dallas is planning a “No Refusal” holiday.

I certainly miss the old days, when we had constitutional 5th amendment rights in these United States.

  2. This is a clear violation of the 5th amendment rights, which states – “No person… nor shall be compelled in any criminal case to be a witness against himself.” The taking of bodily fluids is the most intimate violation of a person’s body, and to do so to produce evidience against that person is undoubtedly against the 5th ammendment. The phlebotomist normally works under a physician’s direction and orders – not a judge’s.

This is insanity and is beyond gestapo tactics. Is there any hope for us?

  3. My husband and I just heard on the news tonight at supper about some
“no refusal” program the police were considering in Houston. We both looked at each other and wondered what that was all about. I spoke with Nancy about another subject a little while ago and she told me about her web site. I came here just browsing and wow, I discovered what “no refusal” is all about. If our own bodily fluids are not our own proterty and protected as such, then obviously we have no property, and if no we have no property, we have no freedom! We have become the property of our government.!
Nancy and Kate thanks for educating us!

  4. They’ll be doing it in San Antonio tonight. How’s the fight going in Austin, what can I do to fight this here?
